Maternal Birth Injuries and Surgical Mesh Case Settles for £350,000
Eoin Kearney acted on behalf of a lady who suffered severe gynaecological and urological injuries during the birth of her child in 2016. Following this, there was what turned out to be a premature clinical decision to insert a TVT-mesh in 2017 which led to further severe injuries.
This case was complicated by the fact that a previous solicitor had obtained an unsupportive expert medical report and the case appeared to be lacking viability at that stage.
A new, world-renowned urogynaecology expert was sourced by Eoin and this Expert established negligence, both in relation to obstetrics care provided around the birth, and the resulting injuries, and also negligence around insertion of the mesh, in that the client was not advised of the severe risks associated with the mesh procedure.
Proceedings were issued in 2020 and the Defendant Health Trust made a number of admissions of liability in 2023 however stopped short of accepting the negligence caused the severity of injury as evidenced by our Experts.
One week before Trial the Defendants entered into settlement negotiations and settled this case at full value. The client was delighted with the outcome and was greatly relieved that she did not have to attend a trial in Belfast.
