£100,000 settlement following negligent hysterectomy procedure

This case involved a substandard hysterectomy operation during which damage was caused to the surrounding organs. Our client required further surgical intervention and endured a complex and protracted recovery. The crux of the case related to whether the damage caused was due to negligent surgical error or whether such damage was deemed a known and acceptable risk of the surgery and therefore not negligent. It was our medical expert’s position that the damage was due to surgical error as opposed to being an acceptable complication of surgery.

Liability was denied throughout the case and the matter was listed for hearing. As is common practice, settlement negotiations did not commence until the date of hearing at which time a figure of £100,000 compensation was agreed between the parties.

Our client was very happy with the settlement figure and felt she was appropriately compensated for the injuries she suffered.
