Victim of a Delay in Diagnosis awarded £100,000

This case involved the failure to diagnose our client’s renal lesion by her Health Trust. After a CT scan in 2014 was carried out due to abdomen pain, our client was advised that she merely had a gallstone. However, the pain persisted and a further CT scan in 2021 highlighted that she had a right lower renal pole neoplastic mass lesion. Our client then required the removal of one of her kidneys through a nephrectomy in 2021 due to the delay in diagnosis.

Eoin Kearney, who acted on behalf of this client, quickly progressed matters and obtained the necessary expert medical evidence which confirmed that that there was a failure to diagnose our client with a renal lesion in 2014 and but for this failure to diagnose in 2014, she would not have required a nephrectomy and would still have both her kidneys.

Liability was admitted by the legal team representing the Health Trust and a figure of £100,000 compensation was agreed between the Parties. Eoin’s actions ensured that this matter was settled very early on, which avoided a long, lengthy and potentially stressful legal process for our client.

Our client was delighted with the settlement figure and felt she was appropriately compensated for the injuries she suffered.
