Mesh Case settles for £250,000

Eoin Kearney took instructions from an elderly client who had an abdominal mesh inserted 2001. This case was particularly complex as the issues raised were of a historic nature and obtaining all the relevant medical records from the Health Trust proved a challenging exercise. Following receipt of all our client’s medical records, an independent expert medical report was obtained from a world-renowned Consultant Urogynaecologist.

This Expert, who we use in all our mesh cases, established negligent medical care in a number of areas, such as the consent process being below and acceptable standard and the actual insertion of the mesh device itself having been carried out negligently. This Expert then provided an additional report to address our client’s severe bladder injuries. Further expert reports were obtained in the fields of colorectal medicine, to deal with a serious bowel injury incurred, and psychiatry, to address our client’s emotional and psychological injuries.

Proceedings were issued in July 2020 and the Defendants entered into settlement negotiations a few weeks before trial in May 2024, resulting in the case settling before our client having to endure the additional stress of attendance at the High Court in Belfast.

This is the first settlement in the numerous mesh cases being taken forward by Brendan Kearney & Company on behalf of ladies adversely affected by mesh surgery.
